Terms of Service
1. Scope and Subject Matter
(1) These Terms of Use govern the use of the platform PlanV (hereinafter "Provider") by registered users (hereinafter "User").
(2) The Provider operates a community platform dedicated to topics relating to vegan lifestyle, animal rights and nutrition. Features include, among others, the provision of information, tracking tools, and the creation and sharing of content by users.
(3) The service is intended exclusively for consumers for private purposes.
(4) By registering or using the services, the User agrees to these Terms of Use.
2. Scope of Services and Availability
(1) As this is a free service, there is no entitlement to permanent or uninterrupted availability of the services.
(2) The Provider is entitled to modify, expand or restrict the scope of features of the platform at any time. This applies in particular to the introduction of new features or the discontinuation of existing ones.
(3) There is no entitlement to storage, backup or restoration of content submitted by the User.
3. Registration and User Account
(1) Active participation (e.g. creating content, saving lists) requires registration. This is done via third-party providers (Single Sign-On, e.g. Google).
(2) The User is responsible for all activities carried out under their user account. They are obliged to protect access from third parties (or to secure their account with the third-party provider accordingly).
4. Rights to User Content
(1) Grant of rights: When the User publishes content on the platform (e.g. texts, images, recipes, comments, data, links), they grant the Provider a royalty-free, geographically and temporally unlimited, non-exclusive right of use.
(2) Scope: This right includes in particular the authority to store the content on the website, make it publicly accessible, reproduce it and technically adapt it so that it is correctly displayed on various devices (mobile, desktop).
(3) Continuation: The right of use to published content remains in effect even after deletion of the user account, provided the Provider anonymises the content or the User does not explicitly and legitimately (e.g. for good cause) request deletion.
(4) Warranty: The User warrants that they hold all necessary rights to the content they submit and that no third-party rights (e.g. copyright, personality rights or trademark rights) are infringed.
5. Prohibited Content and Code of Conduct
The User undertakes not to publish any content that:
- violates applicable law,
- is offensive, racist, discriminatory, pornographic or harmful to minors,
- contains false statements of fact or defamatory criticism,
- includes malware, viruses or technical manipulations,
- contains advertising for commercial purposes or spam.
The Provider reserves the right to remove content that violates these rules without prior notice.
6. Virtual House Rules and Sanctions
The Provider exercises virtual house rights on the platform. In the event of violations of these Terms of Use or in the case of reasonable suspicion of misuse, the Provider may at its own discretion:
- delete or modify content (texts, images, posts),
- issue warnings to users,
- temporarily or permanently block access to the platform.
7. Disclaimer
(1) For content: Content available on the platform partly originates from users. The Provider assumes no liability for the accuracy, completeness, currentness or quality of this information. This applies in particular to recipes, nutritional statements, instructions or tips. Use and implementation is at the user's own risk.
(2) For links: The Provider is not liable for the content of external websites that are linked to.
(3) Limitation of liability: For damages arising from the use of the platform, the Provider is only liable in cases of intent or gross negligence. For damages resulting from injury to life, body or health, the Provider is liable without limitation in accordance with statutory provisions.
8. Privacy
Information on the processing of personal data can be found in the Privacy Policy.
9. Changes to the Terms of Use
The Provider reserves the right to amend these Terms of Use with effect for the future. Users will be notified of changes at an appropriate location (e.g. via a notice upon login or by email).
10. Final Provisions
(1) The law of the Federal Republic of Germany applies.
(2) Should individual provisions of this agreement be invalid, the validity of the remaining provisions shall remain unaffected.
